P.L. 2005, c.171 approved August 5, 2005 (see http://www.judiciary.state.nj.us/legis/2005c171.pdf) codifies the New Jersey Supreme Court decison in Newburgh v. Arrigo, 88 N.J.529 (1982) where the Court established the criteria to be taken into consideration by the judge when making the determination of whether a parent should pay higher education costs.
