Mediation is a settlement process recognized by the Supreme Court of the State of New Jersey.
Beverly and George Hays are Accredited Professional Mediators specializing in divorce mediation. We use a unique model of “a couple working with a couple” in an informal atmosphere to facilitate the parties resolving issues such as development of a parenting plan, child support, alimony, and equitable distribution. We educate and guide the couple through the process to assure that they make informed decisions in their mutual best interests. The parties must agree to provide full disclosure of their finances and provide supporting documentation in order to assure that both of them can make informed decisions.
The end product of divorce mediation is a Memorandum of Understanding, which memorializes all of the facts and agreements made by the parties. Once the mediation process is completed, the parties take the Memorandum to their respective attorneys for review. The Memorandum then forms the basis for their Property Settlement Agreement.
As mediators, we recommend that each of the divorcing parties obtain services of an attorney to counsel them as they go through the mediation process. Where appropriate, we may ask the parties to mutually agree upon the hiring of other professionals, to perform services such as pension evaluation, real estate appraisal or business valuation.
Our services are provided on an hourly basis. Generally, each mediation session is two hours in length. The number of sessions varies depending on the complexity of the case and the parties ability to negotiate.
In our experience agreements made in mediation are far more durable than those made during the litigation process. Generally mediation is less stressful for the couple and their children. It is also faster and considerably less expensive than litigation.
